ZEGOCLOUD Privacy Policy

ZEGOCLOUD PTE. LTD. (“we”, “our”, “us” or “the Company”) is responsible as the operator for processing personal information of our users.

We take the protection of your privacy and personal information very seriously. We collect, store, and use your personal information strictly in compliance with this ZEGOCLOUD Privacy Policy (“Policy”)and with the applicable data privacy laws and regulations.

This Policy is intended to inform you about the scope and purpose for which personal information is processed in connection with the use of the ZEGOCLOUD Platform that link to this Policy or incorporates it by reference. If you would like to register or login your ZEGOCLOUD account, you will be linked to the ZEGOCLOUD Admin Console. You shall read and accept the “ZEGOCLOUD Admin Console Privacy Policy” . For details of account registration and login and any other personal information process rules on ZEGOCLOUD Admin Console platform, please refer to the ”ZEGOCLOUD Admin Console Privacy Policy”.

1. COLLECTION AND USE OF PERSONAL INFORMATION

We will only process your personal information for the purpose of providing services when you use the ZEGOCLOUD Platform. You will only be required to provide personal information that is essential, while you can provide other personal information on a voluntary basis. We will always indicate whether input fields are mandatory or optional. We will inform you the specific details in the relevant section of this Policy.

1.1 Browse Website

When you browse the ZEGOCLOUD Platform, we may collect the Browser type, language, IP address, device information, the web browsing logs(including date and time of access, click records). We collect the foregoing information to show you web content adapted to your terminal.

1.2 Contact us

When you try to cooperate with or contact us, we will collect your name, mobile phone number, email, country, position (role), company name, company email, company website, customer category and help information. We collect the foregoing information to get in touch with you, and present our products, solution and price information for you.

1.3 Live Chat

When you use the Live Chat service, we will collect your country, position (role), company name, WhatsAPP ID, Facebook messager ID, Line ID, and APP ID. We collect the foregoing information to answer your questions and follow up sale leads.

1.4 Operation Stability

When you use the ZEGOCLOUD Platform, we will collect your IP address, browser type, language used, software and hardware characteristic information, user identifier, language, web browsing logs(including the date and time access, click records), Layout Engines, Device ID.

We use the foregoing data to operate the ZEGOCLOUD Platform and ensure stability, security, availability of service, in particular to identify and resolve errors, and to make adjustments or user experience improvements.

2. TRANSFER OF PERSONAL INFORMATION.

We may transfer your personal information to the following categories of recipients:

2.1 Our affiliates

We may transfer your personal information to our Affiliates because they could provide assistance in operation, development and improvement of the ZEGOCLOUD Platform. Our Affiliates will take organisational and technical measures to safeguard your personal information and never use your personal information in contraction to this Policy.

2.2 Our business partners

We employ our business partners to perform functions on our behalf. Examples include the Cloud service provider, the data analysis provider, the web monitoring service provider, the sales& marketing service provider, and the customer services provider. These business partners may have access to personal information needed to perform their functions, but may not use it for other purposes. Further, they must process the personal information in accordance with this Policy and as permitted by applicable data protection laws.

2.3 Our professional advisers and insurers

We may provide our professional advisers and insurers with your personal information where we believe it is necessary to exercise, establish or defend our legitimate interests, to protect your vital interests, rights or property and those of other users, or as otherwise required or permitted by applicable laws and regulations.

2.4 Public authorities

We may disclose personal information if permitted or required by law, for example, in response to a court order or a subpoena. To the extent permitted by applicable law, we also may disclose personal information (i) in response to a law enforcement or public agency’s request; (ii) if we believe disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety or protect the safety of end users; (iii) to protect the security or integrity of our sites, applications, and other technology, as well as the technology of our service providers; or (iv) enable us to take precautions against liability.

We will not transfer the data to third parties without your explicit consent, in particular not for advertising purposes. Your personal information shall only be transferred if you have given your consent to do so, or if we are entitled or obliged to do so due to legal regulations and/or official or judicial orders. This may especially involve the provision of information for law enforcement purposes, for averting danger, or for enforcing intellectual property rights.

We only use your personal information to provide the services you request. If we cooperated with external service providers in the provision of services, they shall also only access the data for the purpose of providing services. We use technical and organizational measures to ensure compliance with the data protection regulations and also ask for compliance on the part of our external service providers in this respect.

3. RETENTION

We will retain your browser information and user information for as long as we provide services or products to you, or as required or permitted by applicable laws. We will either delete or anonymize it as soon as the reason for storing it no longer applies. The data may remain stored beyond this period as required by law, for example in respect of legal retention or documentation obligations. In such an event, we delete or block your personal information once the requirements cease to apply.

How long your data is kept for will also depend on how you use the ZEGOCLOUD Platform and what the information you provide to us is used for. For example, the period of retention may be determined according to your activity or to comply with a specific arbitration period/resolve a dispute.

Your personal information is stored by us on specially protected servers within Chinese Mainland, Hong Kong SAR and Singapore. Technical and organizational measures are taken to protect these servers against the loss or destruction of, access or changes to, or the dissemination of your data by unauthorized persons. Only a limited number of persons will have access to your data. These individuals are responsible for the technical, commercial, or editorial support of the servers. Despite regular controls, perfect and all-around protection against all risks is not possible however.

4. CROSS-BORDER TRANSFER

You acknowledge and agree that we may access and process personal data on a global basis as necessary to provide the products and services, and in particular that personal data may be transferred to and processed by us in Chinese Mainland, Hong Kong SAR, Singapore and other jurisdictions where ZEGOCLOUD Affiliates and business partners have operations.

Wherever personal data is transferred outside its country of origin, each party will ensure such transfers are made in compliance with the requirements of applicable data protection laws and regulations.

5. RIGHTS REGARDING PERSONAL INFORMATION

We take great care to ensure that the processing of your personal information is explained as transparently as possible and that you are also informed about your rights. Should you require more detailed information or want to exercise the rights to which you are entitled, you can contact us at any time so that we can take care of your request.

5.1 Rights of data subjects

Subject to possible restrictions under applicable laws and regulations, as a data subject, you have the right to access, rectification, delete, restriction of processing, and objection to a decision based solely on automated processing with regard to your personal information. In addition, you can withdraw your consent and object to our processing of your personal information on the basis of our legitimate interests. You can also lodge a complaint with a supervisory authority. Details are as follows:

a. You can withdraw your consent to the processing of your personal information by us at any time. As a result, we may no longer process your personal information based on this consent in the future. The withdrawal of consent has no effect on the lawfulness of processing based on consent before its withdrawal.

b. You have the right to obtain access to your personal information that is being processed by us. In particular, you may request information on the purposes of the processing, the categories of personal information concerned, the categories of recipients to whom the personal information have been or will be disclosed, the envisaged period for which the personal information will be stored, the existence of the right to request rectification or erasure of personal information or restriction of processing of personal information or to object to such processing, the right to lodge a complaint with a supervisory authority, any available information as to the personal information’s source (where they are not collected from you), the existence of automated decision-making, including profiling and, where appropriate, meaningful information on its details. Your right to access may be limited by national laws.

c. You have the right to obtain from us without undue delay the rectification of inaccurate personal information concerning you. Taking into account the purposes of the processing, you have the right to have incomplete personal information completed, including by means of providing a supplementary statement.

d. You have the right to obtain from us restriction of processing to the extent where(i) the accuracy of the data is disputed by you;(ii) the processing is unlawful and you oppose the erasure of the personal information;(iii) we no longer need the data, but you need it to assert, exercise or defend legal claims; or (iv) you have objected to the processing pending the verification whether the legitimate grounds of ZEGO override those of the data subject.

e. You have the right to to obtain from us the erasure of your personal data. A valid request to delete personal information will be accommodated within a reasonable time.

f. If your personal information is processed on the basis of our legitimate interests, you have the right to object to the processing of your personal information on grounds relating to your particular situation. This also applies to profiling. If your personal information is processed by us for direct marketing purposes, you have the right to object at any time to the processing of your personal information for such marketing, which includes profiling to the extent that it is related to such direct marketing.

g. You have the right to object to a decision based solely on automated processing, including profiling, except that the decision is necessary for entering into, or performance of, a contract between you and us, or except that the decision is authorized by applicable laws which lay down suitable measures to safeguard your rights and freedoms and legitimate interests, or except that the decision is based on your explicit consent.

5.2 Exercise of rights

You may exercise data subject rights.

Additionally, we are doing everything possible to ensure that you can successfully exercise your rights in accordance with the laws and regulations. When you need to exercise your rights, we may ask you to authenticate to protect your personal information. If you have any questions regarding this Policy or you have a problem exercising your rights, you may send your request in writing to our email address as listed in this Policy.

We reserve the right to charge you a reasonable fee for the processing of any data access or correction request where requests are manifestly unfounded or excessive, in particular because of their repetitive character.

5.3 Complaints

If you are of the opinion that the processing of your personal information by us is not in compliance with this Policy or the applicable data protection regulations, you have the right to make a complaint to a regulatory authority. You can also make a complaint to us. We will then check the matter and inform you about the outcome of the investigation.

6. COOKIES

This section explains how we use cookies and similar technologies (we refer to them collectively as “cookies”) to recognize you when you visit our Platform. It explains what these technologies are and why we use them, as well as your rights to control them.

Cookies are small text files stored on your device, which save specific settings and data for exchange with the ZEGOCLOUD Platform via your device. A cookie generally contains the name of the domain from which the cookie file was sent as well as information on the age of the cookie and an alphanumeric identifier.

We use different cookies to evaluate the performance of the ZEGOCLOUD Platform, to improve your browsing experience, to personalize content and ads, to analyse our traffic and to continually improve services to you. It should be noted that the strictly necessary cookies placed on the ZEGOCLOUD Platform are necessary for the ZEGOCLOUD Platform to function and cannot be switched off in our systems. You can disable the storage of all other cookies and manually delete previously saved cookies via the ZEGOCLOUD Platform settings. And you can choose to accept or refuse the use of all other cookies at any time. If you choose to reject the use of those cookies, you will still be able to use the ZEGOCLOUD Platform while without them, but the ZEGOCLOUD Platform may not function as you expect it to and this could lead to a poor experience on the ZEGOCLOUD Platform for you. 7. MINORS

The ZEGOCLOUD Platform is intended for adults to use. We do not intend to provide any of our services to those we consider to be an individual under the age of adults as specified by laws in your jurisdiction, unless with the involvement of a guardian. We consider it the responsibility of the guardian to supervise the child’s use of our services. We will not make profiling, tracking or monitoring behaviorally or making targeted advertisements on children and other data processing which may cause significant harm to children.

If it can be proved that a minor has provided us with personal information without parental or guardian consent, the parent or guardian should contact us to remove the information. You may send your request for erasure in writing to our email address as listed in this Policy.

8. SECURITY MEASURES

We implement appropriate technical and organizational measures to prevent unauthorized access, to maintain information accuracy and to ensure the correct use of the information we hold. Upon becoming aware of an information breach, we will notify you and the regulatory authorities in accordance with the timescales and scope required by applicable laws and regulations.

Access to the collection system is restricted to the relevant system administrator, and users’ information is stored in the system database, which can only be queried by system administrators with authority.

Additionally, our corporate values, ethical standards, policies and practices are committed to the protections of users. In general, our business practices limit the use and disclosure of such information only to authorized persons, processes and transactions. However, apart from regular controls, absolute protection against all risks is not possible.

No data transmission over the internet or any wireless network can be guaranteed to be perfectly secure. As a result, while we use appropriate technical and organizational measures to protect the information we hold for you, we cannot guarantee the security of any information you transmit over the internet.

9. CHANGES TO THIS POLICY

We may update this Policy from time to time in response to changing legal, technical or business developments.

When we update our Policy, we will take appropriate measures to inform you, consistent with the significance of the changes we make and as required by applicable laws, such as by posting an amended Policy on our website.
